It can be confusing to know what your legal rights are with respect to COVID-19 vaccination and related issues.

New Mexico Resources

In New Mexico, attorney Jon Diener of the non-partisan organization New Mexico Stands Up! has written a letter which you can provide to schools, institutions and businesses to help you push back. This letter explains that it is illegal to mandate unapproved medical procedures, and that these organizations can be held liable for any vaccine-related injuries or deaths[1].

Taking Legal Action

 

The following organizations have stepped forward to assist with COVID-19-related lawsuits. Although it is worth contacting them, they may or may not be able to assist you due to resource limitations. However, they may be able to advise an attorney that you engage.

Overview of Key Points

​

  • COVID-19 vaccines do not have full FDA approval, and are authorized for Emergency Use only. 

​

  • Federal statute FDA 21 U.S. Code § 360bbb–3, which covers Emergency Use Authorization for medical products, requires that individuals who receive a medical product approved for emergency use must first be informed “of the option to accept or refuse administration of the product…and of the alternatives to the product that are available” [2,3].

​

  • If you are being pressured, push back. Try to find others who are willing to stand with you.  We know this is uncomfortable, but your own health and bodily autonomy are at stake.
